User Terms & Conditions
Terms and conditions for using Pingfluence
These Creator Terms of Service ("Creator Terms") apply to individuals who register or use Pingfluence as content creators, Pingfluencers, or influencers (each, a "Creator"). They are issued by Ping Culture Ltd (trading as Pingfluence), a company registered in England and Wales with business address 23 Keith Grove, London ("Pingfluence", "we", "us", "our").
By creating an account, claiming or accepting an offer, or otherwise using the Pingfluence app or related services (the "Service"), you agree to these Creator Terms, our Privacy Policy (incorporated by reference), and any content or collaboration requirements shown for a specific offer at the time you claim it ("Offer Requirements").
Changes to these Creator Terms
We may update these Creator Terms from time to time. We will post the current version on our help centre and update the "last revised" date. Where changes are material, we will use reasonable efforts to notify you in the app or by email before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Creator Terms. If you do not agree, you must stop using the Service and close your account.
Existing collaborations: Changes apply from their effective date to new claims and bookings only, unless we are required by law to apply them earlier. For a confirmed collaboration already underway when new Creator Terms take effect, the version you accepted when you confirmed that collaboration continues to govern that collaboration, except where a later version is more favourable to you or we are required by law to apply the update.
Our role
Pingfluence is a technology platform that helps Creators discover collaboration offers from venues, brands, and other businesses ("Partners") and manage those collaborations. We are not a party to your visit, meal, event, or other experience at a Partner venue, and we do not control how Partners run their premises, staff, or guest policies.
Except as expressly set out in these Creator Terms (including the Serious Incidents section below), we do not investigate, mediate, or resolve disputes between you and a Partner about everyday service issues such as lateness, food or drink quality, table allocation, or booking changes. Those matters should be raised directly with the Partner during or after your visit.
Collaborations and content
When you claim or accept an offer, you agree to attend at the agreed time (or follow the offer's redemption process) and to deliver the content described in the Offer Requirements within the timeframes shown in the app, unless these Creator Terms say otherwise.
You retain ownership of content you create. You grant the Partner a licence to use your collaboration content only as described in the offer and applicable Partner terms. You are responsible for ensuring your content complies with applicable law, advertising disclosure rules, and platform community guidelines.
Safety, discrimination, and leaving a visit
Your safety and dignity come first. If at any time during a collaboration visit you feel unsafe, threatened, harassed, or discriminated against (including on grounds protected under UK equality law), you may leave the premises immediately. You will not be penalised by Pingfluence for doing so, and the collaboration will be treated as fulfilled for purposes of your attendance obligation under that booking, without requiring you to complete promotional content for that offer.
This section does not prevent a Partner from applying its own lawful policies (for example regarding intoxication or violence), but it does not require you to remain in an environment where you reasonably believe you are at risk or being unlawfully discriminated against.
Serious incidents
A "Serious Incident" means discrimination, harassment, threats, violence, sexual misconduct, or another incident that makes you feel unsafe at a Partner venue during a collaboration, or that you reasonably believe should be escalated beyond a routine customer-service complaint.
How to report
- Serious Incidents (Pingfluence): Contact us at safecollab@pingfluence.com as soon as practicable. We use this channel for safety, discrimination, and harassment concerns relating to collaborations. We will acknowledge reports and may take platform action (for example pausing future bookings with a Partner) where appropriate. We do not act as an investigator of criminal conduct or as a substitute for emergency services or regulators.
- Everyday issues: Raise lateness, service, or booking problems directly with the Partner. Pingfluence support may help with app or account issues but is not required to mediate routine venue disputes.
- Emergency: If you or someone else is in immediate danger, contact the police or emergency services first.
Editorial independence
Pingfluence does not direct, script, or approve what you say about your genuine experience at a Partner venue, including experiences involving a Serious Incident. We will not ask you to delete, soften, delay, or withhold lawful content solely because it describes a Serious Incident or criticises a Partner's conduct in connection with that incident.
Content carve-out after a Serious Incident
If you experience a Serious Incident during a collaboration visit, you are not obliged to publish promotional content for that offer (including any content listed in the Offer Requirements). Failure to post such content in those circumstances is not a breach of these Creator Terms or of that offer's content requirements. This carve-out prevails over any conflicting general language elsewhere in these Creator Terms or in the Offer Requirements for that collaboration.
Privacy and sharing your details with Partners
We process personal data as described in our Privacy Policy. We will not share your contact details, private messages, or other personal information with a Partner for coordination of a collaboration unless you have consented, or we need to share limited information to operate the Service (for example displaying your public profile and booking status in the app). Where the app shows a Partner your name or social handle for a confirmed booking, that disclosure is for the purpose of the collaboration you accepted.
Partners must not use your data for unrelated marketing. If a Partner requests data outside the app in a way you did not agree to, contact us at safecollab@pingfluence.com.
Your content and platform moderation
You are responsible for content you post on or via the Service. We may remove or restrict content that is unlawful, infringes third-party rights, or violates our acceptable use rules. Those moderation rights do not extend to asking you to remove lawful content about a Serious Incident for the benefit of a Partner's reputation.
Feedback or suggestions you send us about the Service may be used by us without restriction, except where we agree otherwise in writing.
Acceptable use
You must not use the Service for illegal activity, harassment, hate speech, or fraud. You must be at least 18 years old. We may suspend or terminate accounts that breach these Creator Terms or harm other users or Partners.
Liability
To the fullest extent permitted by law, Pingfluence is not liable for the acts or omissions of Partners (including their staff, other guests, or premises). Nothing in these Creator Terms excludes liability that cannot be excluded under applicable law (including for death or personal injury caused by negligence, or fraud).
Our total aggregate liability to you arising out of or in connection with the Service and these Creator Terms is limited to the greater of £100 or the fees (if any) you paid to Pingfluence in the twelve months before the claim, except where a higher limit is required by law.
Disputes with Pingfluence
These Creator Terms are governed by the laws of England and Wales. Courts in England and Wales have exclusive jurisdiction, subject to any mandatory consumer protections that apply to you.
Last revised: October 2025 (draft for legal review — update date when published).
